Terms and Conditions of Entry for the Activ8me Valentine’s Day Competition 2023

  1. Information on how to enter forms part of these conditions. Entry into this Competition is deemed acceptance of these Terms and Conditions of Entry.
  2. The Promoter of the Competition is Australian Private Networks ABN 27 103 009 552 of 279 Dundas St Preston Victoria 3072 ("Promoter").
  3. The application period for submitting an entry will be open from 9.00am on 1 February 2023 and will continue until 9:00am on 15 February 2023 ("Application Period") (all times are Melbourne time).
  4. Entry is open to all current and potential individual telecommunications customers of the Promoter, over the age of 18 years, but not the Promoter’s employees (and their immediate families) ("Eligible Entrants").
  5. To enter and be eligible to win, Eligible Entrants must during the Application Period:
    1. visit the Promoter’s Facebook post for the Valentine’s Day Competition or email customerfeedback@apn.net.au;
    2. comment on the post or email an answer to the following question in 25 words or less: "Why do you "love" Activ8me?" ("Entry Question"); and
    3. meet the requirements of Facebook or the Promoter applying to users, for example as to format, font, acceptable language and content.
  6. The entry must be:
    1. the original, independent creation of the entrant; and
    2. free from any claims, including copyright or trademark claims by other parties.
  7. Only one entry per Eligible Entrant will be accepted.

Prizes

  1. Judging of all Eligible Entries received during the Application Period will take place on 16 February 2023. The judging will take place at the Promoter’s address shown above. The judging will be conducted by the Promoter’s Marketing Team ("Judges").
  2. The Judges will select 5 winners, in their sole discretion, being the Eligible Entrants who provide the most compelling answers to the Entry Question ("Winners").
  3. The Promoter will offer to each Winner the prize of 1 free month of Activ8me internet service ("Prize"). Each Prize will not exceed the total value of $130.
  4. For a Winner who is a telecommunications customer of the Promoter at the time the Prize is offered, the Prize applies to their current Activ8me internet plan. For a Winner who is not a telecommunications customer of the Promoter at the time the Prize is offered, the Prize is available only if they take up an Activ8me internet plan within 3 months of the offer date.
  5. The Promoter is not liable for any set-up, installation or equipment costs incurred by the Winner if they take up an Activ8me internet plan. These costs are solely the responsibility of the Winner.
  6. The Judges’ decision is final and the Promoter will not enter into correspondence regarding the result.
  7. Each Winner will be notified by phone/email/Facebook Messenger on or before 20 February 2023.
  8. Any Prize which has not been claimed by 5.00pm on 20 June 2023 will be distributed at the Promoter’s absolute discretion.

General Competition Terms

  1. The Prize is not transferable or exchangeable and is not redeemable for cash.
  2. The Promoter accepts no responsibility for any entries not received for any reason during the Application Period. Entries will be deemed to be accepted at the time of receipt by the Promoter and not at the time of transmission. No responsibility will be taken for lost, late or misdirected entries. The Promoter is not responsible for technical difficulties with the entry mechanism and does not warrant that the entry mechanism will be available at all times.
  3. The Judges’ decision is final and binding and no correspondence will be entered into. Incomplete, illegible and incorrect entries or entries containing offensive or defamatory comments, or which breach any law or infringe any third party rights, including intellectual property rights, are not eligible to win.
  4. If, for any reason, the Competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this Competition, the Promoter reserves the right in its sole discretion to take any action that may be available, subject to State and Territory regulations.
  5. Any entrant who, in the opinion of the Promoter, tampers or interferes with the entry mechanism in any way, or who does not properly comply with the entry process, will be ineligible to win.
  6. By entering the Competition, the entrant understands and agrees that the Promoter may use and disclose the information provided by the entrant on the terms and for the purposes (including marketing) set out in the Promoter’s Privacy Statement available at https://www.activ8me.net.au/policy/privacy-policy. The entrant agrees that the Promoter can continue to contact them even after the Competition ends, but the entrant can opt out at any time.
  7. By entering into the Competition, the entrant agrees and acknowledges that:
    1. they may be contacted by the Promoter to provide comments about the competition and the Promoter (or an agent of the Promoter) may take photos and video of them;
    2. the Promoter may use such comments or photos ("Materials") for the Promoter’s future marketing purposes without further reference or compensation to them;
    3. the Promoter may duplicate, alter, adapt and utilise the Materials as the Promoter wishes at anytime, anywhere, and by any means. The Promoter may license, authorise or otherwise transfer the rights in the Materials to others to do the same;
    4. they grant to the Promoter on creation of the Materials a royalty free, perpetual, exclusive and irrevocable licence to use the Materials for whatever purpose;
    5. they unconditionally and irrevocably consent to any act or omission that would otherwise infringe any of their moral rights in the Materials (as defined in Part IX of the Copyright Act 1968 (Cth)) and present and future rights of a similar nature conferred by statute anywhere in the world whether occurring before or after this consent is given ("Moral Rights").
